Welcome to LumeQR.

These Terms of Service (“Terms”) govern your access to and use of the LumeQR website, your LumeQR account, and related online services, and set out the rights, obligations, and responsibilities between you and LumeQR.

By creating an account, accessing, or using LumeQR, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, please do not use LumeQR.

1. About LumeQR

LumeQR is an online service for creating, managing, and publishing dynamic QR pages.

Through LumeQR, users can create QR pages containing text, images, videos, audio, PDF files, links, buttons, and other supported content, and may update page content after publication.

LumeQR is provided as a software-as-a-service (“SaaS”) offering. You receive a limited right to use the LumeQR service in accordance with these Terms and the applicable plan rules. You do not purchase or acquire ownership of the LumeQR software itself.

LumeQR is operated by LumeQR.

2. Account Registration and Security

Certain LumeQR features require you to create an account.

When creating or using an account, you must:

  • Provide true, accurate, and complete information;
  • Keep your account information up to date;
  • Safeguard your login credentials;
  • Be responsible for your account and activities conducted through it.

You must not:

  • Create an account by impersonating another person, business, or organization;
  • Use another person’s account without authorization;
  • Transfer, sell, rent, or share your account unless expressly permitted by LumeQR.

If you become aware of unauthorized access, compromised credentials, or another security issue involving your account, you must promptly notify LumeQR.

3. Eligibility

You must have the legal capacity required under applicable law to accept these Terms and use LumeQR.

If you use LumeQR on behalf of a company, organization, or other entity, you represent that you have the authority to accept these Terms and use the service on that entity’s behalf.

LumeQR does not provide the service to individuals or entities that are prohibited by applicable law from using it.

4. License to Use the Service

Subject to your compliance with these Terms and any applicable payment obligations, LumeQR grants you a limited, non-exclusive, non-transferable, revocable right to access and use the service for the purpose of creating, managing, and publishing your QR pages.

Unless expressly permitted by LumeQR, this right does not include the right to:

  • Copy, sell, rent, sublicense, or resell the LumeQR software or service;
  • Reverse engineer, decompile, or attempt to obtain the source code of the LumeQR software;
  • Modify, copy, or distribute LumeQR technology, interfaces, or other protected materials without authorization;
  • Use automated tools to scrape, access, or interfere with the service at scale;
  • Circumvent LumeQR’s technical, security, usage, quota, or access restrictions.

LumeQR reserves all rights not expressly granted to you under these Terms.

5. User Content and Responsibilities

LumeQR allows users to upload, create, and publish content, including:

  • Text;
  • Images and logos;
  • Videos;
  • Audio;
  • PDF files;
  • Links;
  • Buttons;
  • Business information;
  • Other content created or provided by users.

You retain ownership of the content you upload or create, together with any rights you lawfully hold in that content.

You are responsible for ensuring that:

  • You have all rights, permissions, authorizations, or other lawful bases required to use, upload, store, display, and publish the content;
  • The content does not infringe another person’s intellectual property rights, privacy rights, publicity rights, or other legal rights;
  • The content complies with applicable laws and regulations;
  • Where content contains third-party personal information, you have the necessary legal basis or authorization to process and publish it.

You must not use LumeQR to create, upload, distribute, or publish content that:

  • Violates applicable laws or regulations;
  • Is fraudulent, deceptive, phishing-related, or materially misleading;
  • Impersonates another person or falsely represents an identity, organization, or business relationship;
  • Infringes copyright, trademark, privacy, or other legal rights;
  • Collects, discloses, or distributes personal information without authorization;
  • Contains malware, malicious code, harmful redirects, or other material that threatens network or device security;
  • Is intended to circumvent security measures, content moderation, or other platform protections;
  • Is otherwise prohibited from distribution under applicable law.

LumeQR is not obligated to pre-screen all user content.

To protect users, third parties, and the security of the service, we may use automated tools, manual review, or other reasonable methods to detect, review, and address content.

If we reasonably believe that content violates these Terms or applicable law, presents fraud or security risks, or may harm LumeQR, users, or third parties, we may take appropriate action, including restricting access, suspending display, removing content, or limiting account functionality.

6. Public QR Pages

QR pages created through LumeQR may be made publicly accessible through QR codes or links.

You understand and agree that:

  • Once a page is published, anyone who obtains the relevant QR code or page link may access its content;
  • Page links may be further shared by others;
  • You are responsible for ensuring that the content of a public page is appropriate for public display;
  • You are responsible for lawfully handling any third-party information or content included on the page.

LumeQR provides the technical services required to create, host, transmit, and display QR pages, but does not decide on behalf of users what content should be published on those pages.

7. License to User Content

To provide the LumeQR service, you grant LumeQR a non-exclusive license to use content you upload only to the extent necessary to provide the service.

This license may be used only for the following purposes:

  • Storing and hosting content;
  • Performing necessary technical processing of images, videos, audio, PDF files, and other content;
  • Generating thumbnails, previews, or compatible formats;
  • Transmitting content through networks and content delivery infrastructure;
  • Displaying content to you or to visitors of your QR pages according to your settings;
  • Maintaining, protecting, and operating the LumeQR service.

This license does not transfer ownership of your content to LumeQR.

Once relevant content is removed from the service and is no longer required to provide the service, this license will generally end, except for limited copies retained for backup, security, legal, or reasonable technical purposes.

8. Subscriptions and Payments

LumeQR offers free and paid plans.

The price, features, usage allowances, and other limits of paid plans are those displayed at the time of purchase.

When you purchase a paid plan:

  • You authorize the applicable payment service provider to process payment according to your selected payment method;
  • LumeQR may update your subscription and account status based on the payment result;
  • You are responsible for ensuring that your payment information is valid and that you are authorized to use the selected payment method.

For subscriptions identified as automatically renewing, the payment service provider may process payment for the next subscription period on a recurring basis until you cancel the subscription.

You may manage or cancel your subscription using the methods provided by LumeQR.

Cancellation generally does not affect a subscription period that has already been paid for. Paid benefits may end or change when the current subscription period expires.

If payment fails:

  • LumeQR may be unable to renew your subscription;
  • Your plan or available functionality may be adjusted according to the applicable rules;
  • You may need to update your payment information or take other steps to restore your subscription.

Upgrade, downgrade, refund, credit, and other payment-related rules may vary depending on the applicable plan and payment method and will be governed by the purchase page, checkout page, or other relevant notices.

Where applicable law provides mandatory refund or consumer protection rights, those rights will apply.

9. Free Plans and Service Limits

LumeQR may offer free plans, free usage allowances, or trial features.

Free services may be subject to limits including:

  • Number of pages;
  • Storage capacity;
  • Media quantity, size, or usage limits;
  • Feature restrictions;
  • Download or export restrictions;
  • Branding requirements;
  • Other reasonable service limitations.

Free services do not constitute a permanent commitment to provide any specific feature, allowance, or service condition indefinitely.

LumeQR may modify free plans or free features as the product develops, but such changes will not affect paid benefits that a user has expressly purchased for an already-paid subscription period under the terms applicable at the time of purchase.

10. Service Changes and Availability

LumeQR continually maintains, improves, and updates the service.

We may:

  • Add new features;
  • Modify existing features;
  • Adjust the product interface or service structure;
  • Discontinue certain features;
  • Adjust plans and usage limits.

We will use reasonable efforts to maintain normal and reliable operation of the service, but we do not guarantee that:

  • The service will always be uninterrupted;
  • Every feature will always remain available;
  • The service will be completely error-free;
  • The service will be unaffected by the internet, devices, third-party services, infrastructure failures, or other unforeseen circumstances.

LumeQR may temporarily restrict access to some or all of the service for maintenance, security, system upgrades, technical failures, or other reasonable reasons.

11. LumeQR Intellectual Property

The LumeQR service and related materials, including but not limited to:

  • Software;
  • Website;
  • User interfaces;
  • Product design;
  • Trademarks;
  • Brand elements;
  • Technical implementations;
  • Documentation and other original materials;

are the intellectual property of LumeQR or the relevant rights holders.

Unless expressly permitted by these Terms or applicable law, you may not copy, modify, distribute, sell, rent, or otherwise commercially exploit these materials.

Ownership of content uploaded or created by users remains with the user or the applicable rights holder.

12. Third-Party Services

LumeQR may rely on third-party services to provide certain functionality, including:

  • Payment services;
  • Cloud infrastructure;
  • Database services;
  • File and media storage;
  • Content delivery networks;
  • Authentication services;
  • Email or communication services;
  • Security and error-monitoring services.

These third-party services may be governed by their own terms of service and privacy policies.

LumeQR does not control all aspects of third-party service operations.

To the extent permitted by applicable law, LumeQR is not responsible for interruptions, errors, delays, or changes caused by third-party services that are outside LumeQR’s reasonable control.

13. Prohibited Conduct

When using LumeQR, you must not:

  • Violate any applicable law or regulation;
  • Interfere with, disrupt, or place an unreasonable burden on the service;
  • Attempt to bypass authentication, security, quota, access, or moderation controls;
  • Attack, scan, or test system vulnerabilities without authorization;
  • Access or attempt to access unauthorized data, accounts, or system permissions;
  • Copy, misuse, or exploit LumeQR technology without authorization;
  • Use the service to distribute spam;
  • Use the service for fraud, scams, phishing, or other malicious activity;
  • Upload or distribute malicious code;
  • Use the service in a way that harms the legal rights or interests of LumeQR, other users, or third parties.

14. Suspension and Termination

If you violate these Terms, or if your account, content, or conduct may:

  • Violate applicable laws or regulations;
  • Harm LumeQR, other users, or third parties;
  • Create security risks;
  • Involve suspected fraud, abuse, or malicious activity;
  • Materially disrupt the normal operation of the service;

LumeQR may take one or more actions depending on the circumstances, including:

  • Restricting specific features;
  • Restricting specific QR pages;
  • Suspending page access;
  • Suspending or stopping public display of certain content;
  • Removing content that violates these Terms;
  • Suspending an account;
  • Terminating an account.

For clearly unlawful activity, serious fraud, security incidents, urgent risks, or other situations requiring immediate action, we may take necessary measures without prior notice.

In other appropriate circumstances, we will provide reasonable notice where legally permitted and reasonably practicable.

You may also stop using the service or close your account using the methods provided by LumeQR.

After account termination:

  • Your access to the service may end;
  • Your pages may no longer remain publicly accessible;
  • Related data will be handled in accordance with our Privacy Policy and applicable data retention rules;
  • Subscription and payment matters will be handled according to applicable purchase, cancellation, and refund rules.

15. Disclaimers

LumeQR is provided on an “as is” and “as available” basis.

To the extent permitted by applicable law, LumeQR does not warrant that:

  • The service will be completely error-free;
  • The service will always be continuous, uninterrupted, or available;
  • Every feature will always meet your specific business, commercial, or technical requirements;
  • Content created by users or provided by third parties will be accurate, lawful, or reliable;
  • The service will be unaffected by the internet, devices, third-party services, or unforeseen circumstances.

You are responsible for determining whether LumeQR is suitable for your intended use and for the content you create, publish, and use through the service.

16. Limitation of Liability

To the maximum extent permitted by applicable law, LumeQR will not be liable for indirect, incidental, special, or consequential losses, including:

  • Loss of profits;
  • Loss of revenue;
  • Loss of business opportunities;
  • Loss of reputation or goodwill;
  • Loss of data;
  • Losses caused by third-party services;
  • Losses caused by your own content, settings, or conduct;
  • Losses resulting from events beyond LumeQR’s reasonable control.

To the maximum extent permitted by applicable law, if LumeQR is legally liable for losses arising from or related to your use of the service, LumeQR’s aggregate liability for such claims will generally not exceed the total amount you actually paid to LumeQR for the service during the twelve months preceding the event giving rise to the claim.

If applicable law does not allow certain exclusions or limitations of liability, those exclusions or limitations will apply only to the maximum extent permitted by law.

17. Indemnification

If a third party brings a claim, complaint, investigation, or other legal request against LumeQR arising from:

  • Content you upload, create, or publish;
  • Your use of the LumeQR service;
  • Your infringement of third-party rights;
  • Your violation of these Terms or applicable law;

you agree, to the extent permitted by applicable law, to be responsible for the matter and to indemnify LumeQR for reasonable losses, costs, and expenses arising from it.

The Privacy Policy forms an important part of the rules governing your use of LumeQR.

By using LumeQR, you acknowledge that you have had an opportunity to review our Privacy Policy.

19. Changes to These Terms

We may update these Terms from time to time due to:

  • Changes to product features;
  • Changes to the service structure;
  • Business developments;
  • Security needs;
  • Legal or regulatory requirements.

Updated Terms will be posted on the website and will display a new “Last Updated” date.

If a change may materially affect your important rights or interests, we may provide additional notice through the website, account interface, email, or other reasonable methods.

Where permitted by applicable law, your continued use of LumeQR after updated Terms take effect will constitute acceptance of the updated Terms.

If applicable law requires your express consent, we will obtain it as required.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws applicable to the operation of LumeQR and the related services.

If you have a question or dispute regarding LumeQR or these Terms, we encourage you to contact us first and attempt to resolve the matter through good-faith discussion.

Where applicable law, a competent court, or a regulatory authority imposes mandatory jurisdiction or dispute-resolution requirements in connection with these Terms or the LumeQR service, those requirements will apply.
